Debt Laws Prohibit Collectors from Being Abusive

Regardless of the state of the economy in America, debt is something that people of all ages and coming from every background has to deal with. It’s not merely a matter of simply spending more than what you can afford; debt is the natural result of getting a loan, whether it be for purchasing a home, a car, or some other piece of property or service.

That being said, debt isn’t necessarily bad in itself. It only becomes a problem when it is allowed to get out of hand. If you control debt, it’s simply a matter of making payments on time and in full to reduce and eventually eliminate it. However, if debt does go beyond your means, then you could very well end up in a situation where your debts are forwarded to a collection agency that then goes after you to make payments.

When this happens, you don’t want to have to deal with them any more than necessary, because the collectors can be very aggressive. However, there are certain federal and state laws that prevent these companies from being abusive towards you.

There have been numerous accounts of collectors using insulting, furious language, threatening individuals with legal harm and financial ruin, and telling consumers that they’ll destroy their livelihood in an all-out effort to reclaim what’s owed to them. Collectors do have a right to call and demand payment, but in most cases they can’t force you to do anything on their own and they certainly can’t act abusively.

For instance, if you are bothered by a collector, you can simply tell them to stop contacting you until they develop further means to collect debt from you, such as a court injunction. While you certainly wouldn’t want it to come down to that, the collectors are required by law to heed your wishes and to refrain from contacting you until they proceed with an alternative course of action to claim payments.
